What is a medical expert witness?
A medical expert witness is a registered medical practitioner, often a specialist, retained to give independent opinion on a clinical question in dispute. They may be an independent medico-legal examiner engaged purely to report, or a treating doctor giving evidence about their own patient. Many matters use both.
When you need one
- Causation, whether an incident caused or aggravated a condition
- Quantum, the degree of permanent impairment and future care required
- Standard of care, whether diagnosis, treatment or consent met the expected standard
- Capacity and prognosis, fitness for work and the likely course of a condition
- Critiquing the other side's medical opinion before a joint conference
What a medical expert does
- Examines the claimant and reviews the records, imaging and history
- Forms an independent opinion on diagnosis, causation and impairment
- Applies the relevant impairment guides, commonly editions of the AMA Guides
- Prepares a compliant report and attends a joint experts' conference where needed
- Gives oral evidence and is tested under cross-examination
Choosing the right expert
Specialty fit matters: an orthopaedic question needs an orthopaedic surgeon, not a generalist. Beyond qualifications, look for current registration, genuine independence, report-writing experience and availability that fits your timetable. A brilliant clinician who cannot write a clear, defensible report, or withstand cross-examination, is a liability.
